My legal rights concerning contract mobile phones?
Hi there,
I recieved renewed my contract with Vodafone on the 25th Nov and got a Sony Ericcson Satio… however it is absolutley useless, and is extremely faulty. I have exchanged it for another one (the same model) and is still faulty!! I have since done research and apparently this is quite a common problem with this phone. I have just rang Vodafone, and they told me that they could exchange it again one more time and if the problem still persists then i can exchange it for another model of my choice. Does that mean i can pick any phone at all? lol… it may sound cheeky but i would quite like an iphone… lol… and surely they owe me some sort of compensation for the inconvenience?!! Can i kick up a bit of a fuss over this? It’s just thatall the other phones i have looked at look rubbish compared to what the Satio was supposed to be able to do, and the only other one i would be happy with is the iphone! Any help and advice would be appreciated xx
They will exchange it for one of an equivalent value, or ask you to pay extra. Kick up first though, and tell them that you expect compensation for all your inconvenience. they have the discretion to do this so persist.
Vodafone are a nightmare.
There’s been a lot of problems with the Satio. Of course you are entitled to a phone that works so you can get another replacement but probably better to choose a different model. The N97 is an equivalent phone that shouldn’t give you any trouble. The iPhone isn’t on Vodafone yet – should be in a few weeks though. However you may well have to pay extra as it’s more expensive than the Satio. Might be worth waiting to get an iPhone if that’s what you really want?

Yes.. all goods should be of merchantable quality…
and everything in the contract gets cancelled if one part goes faulty….and you want your refund.

I’m in a similar situation with Carphone Warehouse and a W995 but Carphone won’t replace mine full stop so I would take for granted if you can swap for ANY phone so easily because some of us aren’t getting a fair deal. I also want an iPhone.
